An Alberta Court of Appeal justice has denied NOVA Chemicals Corp.’s request to delay payment of a $3.56 billion judgment to Dow Chemical Canada ULC and Dow Europe GmbH. This decision allows Dow to enforce one of the largest commercial awards in Canadian history, stemming from nearly two decades of litigation over their jointly operated ethylene plant. NOVA had appealed the original award but failed to demonstrate irreparable harm necessary to secure a stay of enforcement.
