Despite continued pressure from the US government, Congress refused to include relevant priority provisions in the annual defense policy bill, but the White House is clearly not stopping there. Three sources familiar with the matter revealed that an executive order aimed at preempting state-level AI legislation—discussed by the White House in November—has now been put back on the agenda. It is unclear whether the contents of this potential executive order are consistent with an earlier leaked draft. The draft executive order obtained by AXIOS calls for aggressive measures, instructing the Attorney General to establish an “AI Litigation Task Force” within 30 days to challenge state-level AI laws.
