Finepac Packaging (00468.HK) three subsidiaries recently filed for arbitration with the Shanghai International Arbitration Center against relevant transaction counterparties.
Grain Hui March 19 | Fenmei Packaging (00468.HK) announced that the company has sought legal advice regarding the investigation results in the second phase report to determine appropriate follow-up actions and potential measures against relevant counterparties. To this end, three of the company’s subsidiaries recently filed arbitration requests with the Shanghai International Economic and Trade Arbitration Commission (“Shanghai International Arbitration Center”) against the relevant counterparties, as detailed below:
The wholly-owned subsidiary Fenmei Packaging (Shandong) Co., Ltd. has filed an arbitration with the Shanghai International Arbitration Center against Vint Packaging (Beijing) Co., Ltd. According to Fenmei Shandong’s arbitration application, Fenmei Shandong seeks a declaration that the entrusted production framework agreement with Vint Packaging (Beijing) Co., Ltd. is invalid for Fenmei Shandong, and further requests the return of delivered goods and paid security deposits; payment for funds occupation; and compensation for damages, with a tentative total amount of approximately RMB 75,595,000.
The wholly-owned subsidiary Fenmei (Beijing) Trading Co., Ltd. has filed an arbitration with the Shanghai International Arbitration Center against Wintipak AG. According to Fenmei Beijing’s arbitration application, Fenmei Beijing seeks a declaration that the trademark licensing agreement and trademark authorization letter with Wintipak AG are invalid for Fenmei Beijing.
The indirectly wholly-owned subsidiary Fengjing Group Co., Ltd. has also filed an arbitration with the Shanghai International Arbitration Center against Wintipak AG. According to Fengjing Group’s arbitration application, Fengjing Group seeks a declaration that the trademark licensing agreement and trademark authorization letter with Wintipak AG are invalid for Fengjing Group.
As of the date of this announcement, the Shanghai International Arbitration Center has not yet issued a ruling on the arbitration requests. The outcomes of these arbitration applications and their impact on the company’s financial position and performance (if any) remain uncertain.
