Recently, Jiaxing Radio and Television Station’s “Xiaoxin Talks” reported: Mr. Fan filed a complaint. He works at a large company in Dushan Port, Pinghu, Jiaxing, with an annual income of 500,000 to 600,000 yuan.

Last September, he received a termination notice from the company after borrowing money from colleagues. Mr. Fan believes that borrowing money is a private matter between individuals and the company should not dismiss him. He is demanding compensation for illegal termination and overtime pay, totaling over 2.4 million yuan. The final ruling has not been issued yet.

Mr. Fan stated that he previously entrusted money to a university alumnus for investment, but due to a sudden break in the funding chain, he couldn’t recover the money and had to borrow from colleagues. He borrowed from more than 30 colleagues, totaling over 2 million yuan. Mr. Fan said he has good relationships with colleagues, knows them well, and trusts them. At the time, he did not write IOUs.

The company’s HR director, Mr. Ke, told reporters that Mr. Fan is an assistant manager in one department, a member of the leadership team. They discovered in March last year that he was borrowing money from department employees. After investigation, they found he borrowed from 36 people in the department, using various excuses. Some employees had no money, and he even advised employees to take out loans on their phones and lend him the money. Others borrowed and repaid, then borrowed again. They learned that Mr. Fan was not using the money for investments but for buying lottery tickets. Mr. Ke stated that besides private lending activities within the company, Mr. Fan was also involved in spying and leaking company secrets. He secretly logged into colleagues’ computers and sent company personnel information to his personal email, which is a serious violation of discipline. After discussion and approval by the union, a notice of termination was issued.

Renowned lawyer Fu Jian, director of Henan Zejin Law Firm, told reporters that Article 39, Item 2 of the Labor Contract Law states that if an employee seriously violates the company’s rules and regulations, the employer can unilaterally terminate the labor contract without paying economic compensation. Mr. Fan, in a managerial position, borrowed over 2 million yuan from subordinates and incited employees to take out online loans. These actions occurred during working hours and within the company, disrupting labor discipline. After warnings and failure to rectify, the company reported the misconduct to the union, obtained approval, publicly disclosed the violations, and finally issued a written notice of termination, complying with the legal procedures for unilateral termination under the Labor Contract Law.
