SEC 終結十年監管模糊
阿特金斯在演說中表示，SEC 過去十年在加密資產分類上缺乏明確指引，目前 SEC 已正式實施全新的「代幣分類標準與投資契約解釋」，這項新框架基於現行法律並廣泛採納公眾意見，將為美國的資本形成與創新提供清晰的法規環境。
四類資產免除證券法監管
根據 SEC 發布的最新解釋，以下四類加密資產已被明確排除在證券定義之外：
數位商品（Digital commodities）BTC、ETH、SOL 等加密貨幣資產
數位收藏品（Digital collectibles）NFT、Web3 遊戲資產
數位工具（Digital tools）ENS 域名（Ethereum Name Service）和實用憑證（Utility Credentials）
符合《Genius 法案》規範的支付穩定幣
這意味著上述資產的開發、發行與交易，未來不再受到聯邦證券法的約束，大幅減輕合規壓力。
受監管的加密資產：代幣化股票、債券與基金
在確立上述四大豁免類別後，阿特金斯進一步釐清，目前僅剩下一類加密資產仍須受到證券法規的嚴格監管，即所謂的「數位證券」（Digital securities）。這類資產是透過區塊鏈技術，將「真實世界資產」（Real World Assets， RWA），例如美國公債、股票、債券與基金等傳統金融資產進行代幣化（Tokenized）。由於這些資產發行的底層仍是證券，因此發行與交易皆須嚴格遵守傳統證券交易法規。
SEC 不再是「萬物證券委員會」
阿特金斯在演說尾聲強調，這項資產區分政策將使 SEC 重新回歸其核心使命與法定權限，也就是專注於保護參與「證券交易」的投資人。他更幽默且堅定地表示：「我們不再是『萬物證券委員會』（Securities and Everything Commission）了。」此宣言不僅確立了加密資產監管的邊界，更為市場帶來更具突破的發展空間。
