美國曼哈頓聯邦檢察官 Jay Clayton 週一向聯邦法官 Katherine Polk Failla 提交信函,要求對 Tornado Cash 共同創辦人 Roman Storm 進行重審,追訴洗錢共謀與違反制裁共謀兩項罪名。檢方建議審期定於今年 10 月 5 日至 12 日前後,預計為時三週。
信函指出,檢方原準備在今年春季即進行重審,但 Storm 辯護律師表示最快到 2026 年下半年才有空檔。Storm 方面則主張,在待決的無罪判決動議(預計 4 月初審議)解決之前,訂定新審判日期「為時過早」。
陪審團曾在兩項重罪上陷入僵局
去年 8 月,曼哈頓聯邦陪審團裁定 Storm「共謀經營未經許可的資金轉帳業務」罪名成立,但在洗錢共謀與違反制裁共謀兩項更嚴重的指控上未能達成一致,使得這兩項罪名成為「懸案」(hung),檢方因此取得重審資格。
Storm 始終否認所有指控,並在 10 月向 Failla 法官提出無罪判決動議,主張檢方未能證明他有意協助不法人士利用 Tornado Cash 從事犯罪。

加密倡議組織批評:「令人極度失望」
加密倡議組織 DeFi Education Fund 法務長 Amanda Tuminelli 也在 X 上發文抨擊司法部重審 Storm 的決定「令人極度失望」。
她指出,檢方「第一次審判就無法說服陪審團」,且在審理過程中犯下多項明顯失誤,包括傳喚無關證人、未能理解自身區塊鏈鑑識分析的證據,並且對第三方開發者責任的指控存在「多重法律與邏輯謬誤」。

值得關注的是,美國財政部本月提交國會的報告中承認,加密混幣器確實存在合法用途,包括那些「希望在消費支出習慣上維持更多隱私」的使用者。
Storm 在貼文中也引述美國副司法部長 Todd Blanche 今年稍早發布的備忘錄,該檔案明確宣示司法部「不是數位資產監管機構」,且該部門將「不再追訴實質上等同於對數位資產施加監管框架的訴訟或執法行動」。
